What does the right of asylum consist of?
The right of asylum is the protection given to non-EU nationals or stateless persons who are recognized as refugees under the terms established in Law 12/2009, of October 30, regulating the Right of Asylum and Subsidiary Protection and in the Convention relating to the Status of Refugees, done at Geneva on July 28, 1951 and its Protocol.
Refugee status is granted to any person who, owing to well-founded fears of being persecuted for reasons of race, religion, nationality, political opinions, membership of a particular social group, gender or sexual orientation, is outside the country of his nationality and is unable or, owing to such fears, unwilling to avail himself of the protection of that country, or to a stateless person who, lacking nationality and being outside the country where he previously had his habitual residence, for the same reasons is unable or, owing to such fears, unwilling to return to it, and is not subject to any of the grounds for exclusion, refusal or revocation established in Law 12/2009, of October 30, regulating the Right of Asylum and Subsidiary Protection.
The protection granted with the right of asylum consists of the non-refoulement or expulsion of the persons to whom it has been recognized, as well as the adoption of the measures contemplated in Spanish regulations, those of the European Union and in the international conventions ratified by Spain.
